Terms & Conditions of Trade

All quotations are valid for 14 calendar days from the date of issue, due to fluctuations in raw material (steel) supply costs. Prices not accepted within this period may be revised without notice.

Quotations are calculated on the physical material footprint of the ordered components only. Unless the Client explicitly purchases the full raw sheet footprint, standard offcuts and skeleton scrap remain the property of ArcForge Designs.

A quotation is deemed accepted once the Client confirms in writing (email, WhatsApp or signature) and pays the required deposit. Acceptance constitutes agreement to these Terms.

Quotes and jobs are based on customer-supplied CAD/DXF files or agreed written specifications. Files are evaluated and cut strictly “as-is”.

ArcForge reserves the right to reject defective files and request client correction.

Alternatively, ArcForge can perform CAD repair, vectorization or nesting at an hourly rate, quoted separately before work begins.

If technical errors in the file cannot be resolved, CAD fees already charged for that attempt are refunded in full; successfully completed CAD repair work is non-refundable.

Design revisions or file clean-ups requested after final sign-off will incur additional CAD/nesting fees.

ArcForge is not liable for errors arising from client-approved drawings, incorrect scaling, unclosed vectors, or specifications supplied by the Client.

A non-refundable deposit of 50% of the quoted price is required upon drawing/nesting approval, before raw material is purchased or cutting commences. The remaining 50% balance is due in full via EFT prior to, or upon, collection or dispatch of finished parts.

No goods will be released from the workshop until cleared funds reflect in the ArcForge Designs bank account. Bank details are provided on the quotation and invoice.

ArcForge reserves the right to suspend work on any job where payment is overdue, and to charge interest on overdue amounts at a rate of 2% per month or the maximum permitted by law, whichever is lower.

Parts are cut to standard CNC thermal plasma tolerances appropriate to plate thickness. Standard dross, mill scale, minor edge bevel and pierce marks are inherent to the plasma cutting process and are not defects.

Tab removal, deburring and surface finishing are only included where explicitly itemised on the quote. Where not itemised, minor manual touch-ups or tab removal remain the Client’s responsibility.

Welding is carried out to standard workshop practice for the material and application specified. Any structural, load-bearing or certified-weld requirements must be disclosed by the Client in writing before work begins; ArcForge is not liable for use of a weld outside its disclosed purpose.

Standard turnaround is typically 2-4 business days, commencing only once the deposit reflects and the final DXF drawing is signed off. Lead times are confirmed per job and may vary with workshop capacity and material availability.

Collection is by appointment at the ArcForge workshop upon completion notice. Delivery can be arranged at an additional fee on request.

Completed orders not collected or accepted for delivery within 14 calendar days of completion notice may incur a storage fee of R100 per day.

Ownership of finished goods passes to the Client only once payment has been received in full and cleared funds reflect in the ArcForge Designs bank account. Until then, ArcForge retains title to all materials and finished parts, whether or not they are in the Client’s possession.

Risk in the goods passes to the Client on collection or upon dispatch for delivery, whichever occurs first.

To the maximum extent permitted by law, ArcForge’s total liability for any claim arising from a job is limited to the value of that job’s invoice. ArcForge is not liable for indirect, consequential or special damages, including loss of profit or business interruption.

The Client indemnifies ArcForge against claims arising from inaccurate specifications, files or instructions supplied by the Client, or from the Client’s use of the finished parts for a purpose not disclosed to ArcForge in writing.

Nothing in these Terms limits any liability that cannot lawfully be excluded or limited.

The Client warrants that any design, drawing or DXF file supplied does not infringe the intellectual property rights of any third party, and indemnifies ArcForge against any claim to the contrary.

Where ArcForge creates or modifies a design, drawing or nesting layout on the Client’s behalf, ownership of that work product passes to the Client only once it has been paid for in full. ArcForge may retain copies for record-keeping and quality-control purposes.

Once a deposit has been paid, the order is confirmed and the deposit is non-refundable, as it secures materials and workshop time. Only if the Client cancels before material has been cut, ArcForge will deduct the cost of materials and work already committed from the deposit and refund any remainder at its discretion.

ArcForge is not liable for delay or failure to perform caused by circumstances beyond its reasonable control, including load-shedding, supplier shortages, extreme weather, civil unrest or equipment failure. Affected lead times will be communicated to the Client as soon as reasonably possible.

These Terms are governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.

ArcForge may update these Terms from time to time; the version in force at the date of quotation acceptance applies to that job.

No failure or delay by ArcForge in enforcing any provision of these Terms constitutes a waiver of that provision.
